After some tag-testing i removed the <p> tag from the disclaimer (while debugging) and replaced it with a <br> line break aaaaaaaaand: the problem is gone (as far as i see).
I've now removed it from mail policy as well. I'll wait till the new disclaimer is pushed to iNotes as well and will then test again.
It looks like the whole problem is really based on the simple paragraph "<p>" tag
